SUMMARY OF LEGISLATION- LIVING WON'T
A number of states in an effort to promote fairness have created
an opposite to the living will, which for lack of a better word
we call a "Living Won't." States that specifically allow for
"living wont's" are mentioned in their individual summaries.
A "living won't" provides, that when a person is unable to make
decisions for himself regarding his medical treatment that their
previous document either requires or authorizes the provider of
medical services to CONTINUE life support, even after a terminal
diagnosis and even if the result is a meaningless existence. It
is quite probable that such a document would be recognized even
in states that do not have specific provisions. It might be
said that a "living won't" provides for the regular course of
medical care to continue, but, it may have the effect of
requiring care far beyond where the same would do any good. More
flexibility is provided by the decision to do nothing.
